1. Đối với giấy tờ Việt Nam sử dụng tại nước thành viên Công ước Apostille:
- Khi giấy tờ công của Việt Nam được sử dụng tại quốc gia/vùng lãnh thổ thuộc phạm vi áp dụng của Công ước Apostille, người có giấy tờ có thể thực hiện thủ tục cấp chứng nhận Apostille theo quy định thay cho thủ tục hợp pháp hóa lãnh sự, trong những trường hợp Công ước được áp dụng.
- Cơ quan có thẩm quyền của Việt Nam thực hiện cấp chứng nhận Apostille theo quy định của Nghị định số 293/2026/NĐ-CP.
2. Lưu ý quan trọng đối với giấy tờ sử dụng tại Lào:
- Việc Việt Nam gia nhập Công ước Apostille không đồng nghĩa tất cả giấy tờ sử dụng tại Lào đều được áp dụng Apostille.
- Đối với giấy tờ Việt Nam sử dụng tại CHDCND Lào, đề nghị công dân, cơ quan, tổ chức kiểm tra phạm vi áp dụng của Công ước và các điều ước quốc tế có liên quan giữa Việt Nam và Lào trước khi thực hiện thủ tục.
- Trường hợp giấy tờ không thuộc diện được miễn theo điều ước quốc tế hoặc quy định pháp luật có liên quan thì vẫn thực hiện chứng nhận lãnh sự/hợp pháp hóa lãnh sự theo quy định hiện hành.
3. Đối với giấy tờ nước ngoài có Apostille sử dụng tại Việt Nam:
- Giấy tờ công của quốc gia thành viên Công ước Apostille đã được cấp chứng nhận Apostille hợp lệ và thuộc phạm vi Công ước có thể được sử dụng tại Việt Nam theo quy định, không phải thực hiện thêm thủ tục hợp pháp hóa lãnh sự, trừ trường hợp pháp luật có quy định khác hoặc thuộc trường hợp bị từ chối tiếp nhận.
4. Một số trường hợp vẫn phải thực hiện hợp pháp hóa lãnh sự:
- Các giấy tờ không thuộc phạm vi áp dụng của Công ước Apostille, hoặc thuộc trường hợp được pháp luật/điều ước quốc tế quy định phải thực hiện thủ tục chứng nhận lãnh sự, hợp pháp hóa lãnh sự, vẫn thực hiện theo thủ tục hiện hành.
- Đặc biệt, đối với các giấy tờ sử dụng giữa Việt Nam và Lào, đề nghị không tự động thay thế thủ tục hợp pháp hóa lãnh sự bằng Apostille khi chưa xác định rõ giấy tờ thuộc phạm vi áp dụng.
5. Đề nghị đối với công dân và các cơ quan, tổ chức trên địa bàn:
Tổng Lãnh sự quán đề nghị các cơ quan, tổ chức, doanh nghiệp và công dân:
- Chủ động xác định nước nơi giấy tờ sẽ được sử dụng và phạm vi áp dụng của Công ước Apostille;
- Không nhầm lẫn giữa chứng nhận Apostille, chứng nhận lãnh sự và hợp pháp hóa lãnh sự;
- Trước khi nộp hồ sơ, kiểm tra yêu cầu của cơ quan có thẩm quyền của nước nơi giấy tờ được sử dụng;
- Trường hợp chưa rõ thủ tục, liên hệ Tổng Lãnh sự quán để được hướng dẫn theo thẩm quyền.

CONSULAR COMMUNIQUÉ
On July 23, 2026, the Government of Vietnam issued Decree No. 293/2026/NĐ-CP guiding the implementation of the Hague Convention of October 5, 1961, abolishing the requirement of legalization for foreign public documents (Apostille Convention). The Decree takes effect on September 11, 2026.
Vietnam officially became a member state of the Apostille Convention on September 11, 2026. Pursuant to the Convention, an Apostille certificate is issued to authenticate the origin of a public document, including the verification of the signature, the capacity in which the person signing has acted, and the identity of the seal or stamp affixed to the document.
1. Regarding Vietnamese public documents to be used in member states of the Apostille Convention:
- When a public document of Vietnam is to be used in a country or territory within the scope of application of the Apostille Convention, the document holder may carry out procedures to obtain an Apostille certificate in accordance with regulations, replacing consular legalization procedures in cases where the Convention applies.
- Competent authorities of Vietnam shall issue Apostille certificates pursuant to the provisions of Decree No. 293/2026/NĐ-CP.
2. Important notice regarding documents to be used in Laos:
- Vietnam's accession to the Apostille Convention does not imply that an Apostille applies automatically to all documents used in Laos.
- Regarding Vietnamese public documents to be used in the Lao People's Democratic Republic, citizens, agencies, and organizations are requested to verify the scope of application of the Convention and relevant international treaties between Vietnam and Laos prior to initiating procedures.
- In the event that a document does not fall under the categories exempted by international treaties or relevant legal regulations, consular certification or consular legalization shall continue to be carried out in accordance with current regulations.
3. Regarding foreign documents bearing an Apostille to be used in Vietnam:
- Public documents issued by member states of the Apostille Convention that bear a valid Apostille certificate and fall within the scope of the Convention may be used in Vietnam in accordance with regulations, without requiring further consular legalization procedures, except where otherwise provided by law or where acceptance is refused under applicable provisions.
4. Cases where consular legalization remains mandatory:
- Documents that fall outside the scope of application of the Apostille Convention, or those required by law or international treaties to undergo consular certification and consular legalization procedures, shall continue to follow current procedures.
- Specifically, regarding documents used between Vietnam and Laos, citizens, agencies, and organizations are advised not to automatically substitute consular legalization procedures with an Apostille without clearly verifying whether the document falls within the applicable scope.
5. Recommendations for citizens, agencies, and organizations within the consular district:
The Consulate General requests all agencies, organizations, enterprises, and citizens to:
- Proactively identify the destination country where the document will be used and the scope of application of the Apostille Convention;
- Avoid confusing an Apostille certificate, consular certification, and consular legalization;
- Verify the specific requirements of the competent authorities of the destination country prior to submitting dossiers;
- Contact the Consulate General for official guidance within its jurisdiction in cases where procedures remain unclear.
